Privacystatement

Application

This Privacy Statement applies when the data subject

  • visits the offices, showrooms, websites of the processing manager
  • uses apps and online tools provided by the data controller
  • or where the data subject is a potential or former customer of the controller.

If the data subject makes use of services of other parties such as chat, third party websites, forums, social media, newsgroups and/or apps via the websites, online tools or e-mails of the data controller, the data controller has no control over this and is therefore not responsible for the information that the data subject posts on these and the further processing of this information by these other parties.

The websites or social media channels of the data controller sometimes include links to third party websites (external websites, other social media, partner websites, organisers of events we sponsor, etc.) whose terms of use do not fall within the scope of this privacy statement. The data subject is asked to carefully read their personal data protection policy.

Processing purposes

The data controller collects and processes the personal data of the data subject for a.o.

  • customer records;
  • follow-up of orders/deliveries;
  • billing;
  • monitoring solvency;
  • profiling and sending marketing and personalized advertising;
  • improving the products and services of the controller;
  • requesting feedback on services provided by the controller;
  • compliance with legal obligations incumbent on the controller;
  • studies, tests and statistics, for e.g. trend analysis.

Type of data

Among other things, the controller processes personal data. These are data relating to the person concerned and which

  • provided by the person concerned;
  • allocates the controller to the data subject for the use of his products and services;
  • the data controller obtains through the use of his products and services by the data subject or;
  • has received the controller via third parties.

All data collected by the processing manager can be combined to optimize his offers and services.

There are different types of personal data:

  • User data: allows the data controller to identify or contact the data subject. For example: name, address, telephone number, language preference, copy of the front of the identity card, fto's containing the data subject, gender, e-mail address, age, family composition and any other preferences the data subject may express through websites, social media, actions, mobile applications, e-mails, competitions, etc., including their financial and creditworthiness data;
  • Technical data: this is required by the person responsible for processing in order to ensure the proper functioning of his products and services.
  • Traffic data: this special technical data is required by the data controller to handle traffic over electronic communications networks, such as an anonymised IP address or MAC address;
  • Location data: these data enable the controller to determine the location of the data subject's access to the Internet.
  • Data relating to the data subject's use: the data received by the data controller when the data subject uses its products and services. For example: which products the person concerned purchases. The data controller uses this information, among other things, to be able to bill the data subject as a customer correctly and to offer the data subject a better and personalised experience.

The data controller shall not process sensitive data such as, inter alia, data relating to racial or ethnic origin, political opinions, sexual preferences and health of the data subject.

Legal basis(s) of the processing

Personal data is processed on the basis of the following articles of the General Data Protection Regulation:

1.a. Consent: The data subject gives permission to use his/her personal data for marketing purposes.
1.b. The processing is necessary for the performance of a contract to which the data subject is a party, or to take measures at the request of the data subject prior to the conclusion of a contract.
1.c. The processing is necessary to comply with a legal obligation incumbent on the controller.
1.f. Necessary for the protection of the legitimate interest to undertake.

Transfer to third parties

If this is necessary for the realisation of the intended purposes, the personal data of the data subject will be shared with other companies within the European Economic Area that are directly or indirectly linked to the controller or with any other partner of the controller.

The data controller guarantees that these recipients will take the necessary technical and organisational measures to protect personal data.

Storage period

Personal data processed for customer management purposes will be retained for the period necessary to comply with legal requirements (e.g. in the field of accounting). The personal data processed for marketing purposes will be stored for a period of 365 days.

Right of access, rectification, erasure, restriction, objection and portability of personal data

The data subject has the right at all times to inspect his or her personal data and can correct them (or have them corrected) if they are incorrect or incomplete, have them removed, have them restricted and object to the processing of his or her personal data on the basis of Article 6.1.f, including profiling on the basis of those provisions.

The person concerned always has the right to withdraw the consent given on the basis of Article 6.1.a..

Moreover, the data subject has the right to obtain a copy (in a structured, common and machine-readable form) of his personal data and to have the personal data forwarded to another company.

Data obtained via the websites, online tools, apps and e-mails of the controller

In addition to the data that the data subject voluntarily shares with the data controller when using his or her websites, the data controller also uses cookies and other technological means to collect data.

The data subject may visit the websites of the data controller without disclosing any personal data. With his consent (to the extent necessary), the data controller can inform the data subject, as a visitor to his websites, about a personalised offer of products and services. Some features or functions are reserved for customers or visitors with an account. The data controller then identifies the anonymised IP address and links it to the data subject's customer data.

Data obtained via cookies

In order to optimise the service, the data controller may further supplement the personal data of the data subject with the data derived from the cookies resulting from the use by the data subject of the websites, online tools, apps and e-mails of the data controller.

Cookies can be placed both by the controller and other parties. If the data controller allows third parties to place cookies on its websites, online tools, apps and e-mails, these parties must contractually guarantee a secure connection over which the data will be exchanged.

Cookies" also include meta files. These are similar technologies such as flash cookies, device fingerprint, html5 local storage and javascripts.

If he or she prefers, he or she can reject the cookies on his or her first visit, or he or she can unsubscribe from certain cookies via optout.networkadvertising.org. Furthermore, the data subject can disable or delete all installed cookies from their computer or mobile terminal at any time via the settings of their browser (usually under "Help" or "Internet options"). The data subject should bear in mind that changing the settings may cause websites, online tools, apps and e-mails from the data controller and other websites to malfunction.

Complaint
